Speeding 40 to 49 km/h over: 4 points, licence seized
The last band before the criminal offence. The fine is still class 4, but if the police stop you, you drive away without your licence.
Speeding by 40 to 49 km/h is a class 4 offence: a €135 standard fine, €90 reduced, €375 increased. Article R413-14 takes four points and allows a court to suspend the licence for up to three years. The difference from the band below lies in being stopped: when the driver is pulled over at the roadside, police seize the licence on the spot for seventy-two hours, and the prefect may then suspend it for up to 6 months under article L224-2, as in force since 20 August 2026. After a mere camera flash, the ANTAI notice follows the usual fixed-fine route. Example: 128 km/h measured by a fixed camera on an 80 road gives 121 km/h recorded, 41 km/h over and 4 points. One more recorded km/h beyond 49 over, and it becomes the criminal offence of extreme speeding.

The speeds that lead to this band
| Limit | Recorded | Fixed camera: measured | Offence from (measured) |
|---|---|---|---|
| 50 km/h | 90 – 99 km/h | 95 – 105 km/h | 106 km/h |
| 70 km/h | 110 – 119 km/h | 116 – 126 km/h | 127 km/h |
| 80 km/h | 120 – 129 km/h | 127 – 136 km/h | 137 km/h |
| 90 km/h | 130 – 139 km/h | 137 – 147 km/h | 148 km/h |
| 110 km/h | 150 – 159 km/h | 158 – 168 km/h | 169 km/h |
| 130 km/h | 170 – 179 km/h | 179 – 189 km/h | 190 km/h |
In a built-up area, 96 km/h measured where 50 is allowed is enough for 41 km/h recorded over. On an 80 road the percentage margin above 100 km/h pushes back the offence threshold: you need 137 km/h measured to be recorded at 130 km/h.
Stopped or flashed: two different outcomes
Flashed by an automatic camera, you receive a class 4 notice: payment, points taken, no seizure. Stopped by a patrol, you receive the same report, plus a licence-seizure notice and, most often, a suspension order from the prefect. Article L224-2 in force sets the maximum at 6 months for speeding. The licence suspension page sets out the procedure.
Does my speeding mean a suspension?
Court suspension
up to 3 years
| Licence seized if stopped | yes, 72 h then up to 6 months (prefect) |
| Recorded speed | 125 km/h |
| Criminal offence | no |
Four points in one go
With 8 points left on a full licence, the margin gets thin; on a six-point probationary licence two remain, and a course becomes compulsory. The four points return after three years with no new offence, or through a course.
